Can I apply as a dependent for ILR?

Post by giftofspeed » Mon Nov 30, 2009 4:24 pm

My wife is eligible for her ILR application. I have my own HSMP for over 2 years now. Can I include myself as a dependant in my wife's ILR application?

Someone told me that I may have to reenter UK as my wife's dependent otherwise I'll have to wait for a couple years until I become eligible for my own ILR

Thanks for your time

No. Only people with leave as dependants may be included with the main applicant.

Yes, unless she's applying for SET(O) under Long residence.

Hello Venny

Just to confirm,

Does this mean that my wife who is in the UK as my dependent since 2007 can apply with me in the same SET(O) form ?

I 'll be completing my five years (3 years work permit + 2 years Tier 1) soon and would like to apply for ILR under Tier 1 along with my wife and son in the same form if it is possible at all.

Hope you are able to assist. Thanks.

Possible.

If child was born in the UK, then see also baby to born 20 days before applying for ILR - need advice.
