Can i apply for indefinate now as i have sppouse visa

Post by ferrarilondon » Tue Aug 10, 2010 3:46 pm

Hi there,

Please help me as i am confused about my next step in taking indefinite leave to remain.

I have been in UK since 2001 on student visa.
Got married ( religious wedding, Nikah ) to my British wife in UK in April 2008.
Got married in local registrar office in Dec 2008.
Our son was born in feb 2009 and i changed to sppouse visa in march 2009.

Can I apply for indefinite now as we have been married more than 2 years ( from april ) or would they count from March 2009 when i got my sppouse visa.

Please help Thanks

The 2-year probationary period stated from when they granted FLR(M) or from when you initially entered the UK on a spouse visa.

You should use application form SET(M) if you:

* currently have temporary permission to remain in the UK as the husband, wife, civil partner or unmarried/same-sex partner of a British citizen or a person settled here;
* have lived here for two years in this category; and
* are still planning to live together (and are still married or in a civil partnership, if applicable).
KOL required.
Don't forget to collect the documents as requested on the SET(M) form.

You may apply for ILR no more than 28 days before the completion of your probationary period and before your leave expires.
