Can I apply PSW on my undergrad award while Im doing master?

Post by nickaelwen » Tue Dec 28, 2010 11:00 pm

Dear all,

My student visa is valid till end of Sep. 2011. I have been awarded my undergraduate degree with first class this July. My student visa is an old system visa which was granted in 2007 for 4 years till next Sep.
But I am currently studying in an postgraduate degree which finish next June.
Can I apply PSW on basis of my undergraduate degree award?
If so , can I apply now?
I want to have my PSW visa before immigration rules change but I have a concern that, if I will be granted. Would the PSW start date being Sep. 2011 in link of my current student visa? Or Would immigration revoke my current student visa for some period which is not the thing I wanted, because I want to complete my current postgrad study and to work after this under PSW.

Please help!!

On the basis of your undergraduate degree with first class this July, you are eligible to apply for PSW (Read the current forms and guidance very carefully). You can do one thing either keep continue doing your masters or apply for PSW but when you get PSW then 24 months clock start the day u get it...will not start in Sep 2011 no way!!! when you get PSW you should be working as it says post study work....not studying...but many people do study..
Im sorry im not sure is it legally right or wrong...never think for once in mind that you can get another PSW after finishing ur masters..
So your very own choice PSW or study or both!!
Wishing you Good Luck

Thanks, Nicecareing.

My goal is to get PSW before government shut it down. But I really want to do it as late as possible so it will not revoke my current student status too much. Ideally, if government does not change it until next April, I can apply by April, by the time I received my visa(roughly early June) I will be finish my study.

If I am right, the PSWR issue is currently under consultation right?

Do you think I should wait for further news and in the mean time prepare documents for the application? Since they will not just precipitant close PSWR on the day of announcement, right?

your thinking is right for what you want. wait until UKBA take the decision about PSWR and by this time maintain the fund requirement.

Don't forget that Tier 1 General was closed to overseas applicants with very little notice.

Yeah, I am aware of that. I am in the UK and I plan to apply within the UK. They should give some weeks notice at least. It is very unreasonable to just shut it done at announcement. right? At least I can apply on Feb next year since the current consultation close at 31st of Jan 2011.

im slightly confused...

you say that you were awarded student visa in 2007 and that you completed your studies this July. How come you have 1 more year left on your visa?

According to UKBA, if your course finishes early, then you must leave after 3 months of being awarded degree!

Why I have 1 more year visa?

This is because my degree programme was 4 year including one year placement. So I got 4 year student visa. But I did not take the placement year, instead I went straight to the final year, then I got one year extra. Because my student visa was an old system visa, not PBS visa. So I can use the remaining one year visa to study full time anywhere without any notice to home office, this is the old immigration rule, and the old immigration rule apply to me till my current student visa runs out. In other words, old immigration rules apply in any issue regarding my current leave to remain.

Don't be confused.
I did research before I made this decision before I re-enter the UK. I am sure I found a page on UKCISA website which exactly describe my situation, if you want to see you can find it. What you got on UKCISA website applys to current PBS visa system, if you look closely from UKBA website under Tier 4 students section, they state if the visa was issued before March 2008 the old immigration rules still apply until your current visa runs out.
And another source is visa advice page from LSE website. They also advise that old system student visa need not do anything if the visa covers the study period.

I am lazy to find those websites for you. But search concisely with your words you can find it.
