Can we convert our fiance visa to an unmarried partner visa?

Post by kid13 » Fri Jan 06, 2012 1:39 am

Hi guys, I've been with my partner since June 2010, and last month he got his UK fiance visa, and he's here living with me now.

I want to know whether it's possible to change your mind about getting married once your fiance has got his fiance visa and is in the UK... Is it possible to 'convert' it into an unmarried partner visa? I didn't consider this visa before because I thought it was just for homosexual couples, but now I see it's for either.

What are the chances of converting to the unmarried partner visa? We've been together since June 2010 but spent nearly a year living apart (although in a relationship) since they refused him a tourist visa in January last year.

Grateful for any advice, thanks.

Unfortunately, you do not qualify.

Hi, thanks for your reply. In the 12 months living apart, I visited him 3 times. Longest between visits was 4 months. Would that make a difference?

no. You need to have been living together in a relationship akin to marriage for two years. Visiting him 3 times over 12 months is not living together.

Assuming OP meets all the conditions, it is questionable whether her partner can switch to an unmarried partner visa from a fiance visa, when the purpose of the fiance visa was for the fiance to enter the UK with the view of getting married within a period of 6 months.

I agree with Obie....apart from the fact that in your case you don't qualify anyway for an Unmarried Partners Visa whether applied for either from within or outside the UK.

Yes - didn't add that it is not possible to switch from finance to unmarried partner as it is not leave that is granted for more than 6 months.
