Can I get BRP card with an Expired CoE-ROA

I'm thinking of applying for "Application For No Time Limit (NTL)" - I've already got a foreign passport with CoE-ROA sticker, though the passport is expired.

My questions are:
1) Would I be able to get a BRP card, by submitting an NTL form
2) Can I do this, without having to obtain a new foreign passport, which wouldn't contain my CoE-ROA sticker

I'm asking because the CoE-ROA allows me to stay in the UK without immigration control, though It'd need to be renewed to travel abroad. Since a valid passport is needed to work, whether it'd be possible to obtain a BRP card whilst I'm attempting to claim a Status Letter from the Home Office.
