Can I make a fresh application when i've sent off the appeal

Post by Abi99 » Sat Sep 12, 2009 5:17 pm

Hi all,
I was refused the PSW appliction in june due to this maintenance of funds palava and long story short, i went for an appeal which has just been refused on the same grounds. i am going to appeal again and i wanted to know if i could put in another applictaion to HO.

my visa expired in april (i sent the application before it expired), i was refused in june and my hearing was on 3rd of september and i was refused on 9th of september.
would i be classified as an overstayer?

i have read in the guidance that i would not be classified as an overstayer. however, i have read some stories where the HO still see you as an invalid applicant.
this worries me a lot.

and also, in the application form, there is a section that says asks if the date on the visa on the passport has passed and if it has, one should not continue with the applictaion.
has this scenario happened to anyone? if yes, please advise.
thank you.

1. As long as u were dealing with an appeal then u r not an overstayer.
2. U will be an overstayer if u do not leave the UK after all the appeal process and after the date of the last appeal (28 days after that appeal).
3. So u need to leave after the last notfication of the apeal which is 28 days.
4. If u apply again it wil be considered as invalid application. The only thing u can do is to appeal again and then withdraw the appeal and apply (Some people got the visas and some did not so its a chance).
5. I wud say go bak home and apply from home (Assuming that u r not an IGS applicant cuz IGS can not apply from bak home).
