Can my child (family\dependent visa) attend university overseas?

Hello everyone!

My child is currently on a family visa which started when he was 16. We are now coming up for renewal, and he will be 18. All good, since he applied before he was 18.
However, if he attends fulltime university in the Netherlands from next year, studying there for 3 years, will he be able to satisfy his visa requirements, and apply for ILR after that? Or will he have essentially ruined any 'staying in the UK' requirements? I can't find anything online about this.

IE Will attending university outside the country count against him?
He will still be a dependent, even though he is not living with us. He will return home to the UK during uni holidays, and keep his room with us.

But he would use his Dutch passport to attend university there - does that make any difference?

This is fascinating - no replies. I have also been in touch with Home Office who couldn't help me.
Anyone have an idea?

To the best of my knowledge, the child can continue as a dependent provided they are "not leading an independent life".
Appendix Children caseworker guidance wrote:Independent life requirement

This section tells you about the independent life requirement for dependent children.

The independent life requirement applies to all dependent children regardless of their age.

‘Must not be leading an independent life’ means that the applicant meets both of the following requirements:

does not have a partner

is living with their parent (except where they are at boarding school, college or university as part of their full-time education)

‘Does not have a partner’ means that the applicant must not be married, in a civil partnership or in a relationship similar to marriage which has lasted for 2 years or more at the date of application. See also the guidance on Relationship with a partner.

The age that a person can marry or enter into a civil partnership varies from country to country. You should check partner status on the application form which you can access on the case work system.

You should also check the application form to see if the applicant is living at the same address as their parent or parents. If the applicant is not living with their parent or parents due to attending boarding school, college or university, you will need to be satisfied that the child normally lives with their parent. If the applicant is living at a different address to their parent or parents, you must be satisfied that this is due to study elsewhere. If the applicant is studying, the name of the school, colleague or university will be on the application form alongside the duration of the studies.

It is a common occurrence for students to live in university or shared accommodation while they study. Living in shared accommodation with a boyfriend or girlfriend where you are satisfied that the applicant is studying would not mean they are living an independent life, provided there are not indications that the relationship is one similar to marriage and has subsisted for 2 years or more, such as evidence of shared finances (for example, shared bank statements).

If a child is applying from overseas to join their parent(s) or a relative in the UK, this does not necessarily mean that they cannot meet the ‘must not be leading an independent life’ requirement. Where they are living with a relative other than a parent who may act as their sponsor or carer, they can meet the Independent Life requirement regarding accommodation.
Note that in any case, extensive absence from the UK will impact any future naturalisation application. The child can continue on the child dependent route till ILR, but, once granted ILR, the child is no longer a dependent and will need to meet all the standard requirements for naturalisation as an adult in their own right. There are three different requirements that the child may fail to meet; the number of absences from the UK over one year and five years (those are two separate requirements) and the requirement to be physically in the UK at the start of the five year period immediately before the date of naturalisation.

And keep in mind that any continuous absence from the UK for more than two continuous years would automatically cancel any leave, whether limited or indefinite.

I also had feedback from another lawyer who said what you have. The main point is 'dependence'.

Is he dependent if:
He would be receiving a grant from the government, so we wouldn't be paying his fees or accommodation. But the grant is based on my earnings and my wife's.
We are the home he would return to every holiday.
We'd send grocery and phone money every month to him.
He would not be married.
He would return home after studying, to live in our home.
