Can son with 5 days via left on Tier 1 enter UK

Wife and I - ILR issued April this month
Son 2 yrs old, born in UK, and has been on Tier 1.
I have not done his MN1 yet and his T1 G dependent expired 25 OCT.

Now my wife (ILR) and him (T1 till 25 OCT) needs to Travel to India importantly. They planing to return 20 OCT - will immigration on return cause issues that son via is only 5 days pending and etc etc?

Please Assist.

How can your 2 year be on Tier 1?
He must be on PBS dependant leave!!

As long as a migrant has valid leave, he may enter UK.

So I was on Tier 1 (G) when he was born in UK, we wanted to travel so got him Tier 1 (G-Dependent) visa. I got ILR and have not done his MN1 yet.
