Can you lose workrights while stamp4 is in process

Post by amm1155 » Wed Apr 24, 2024 5:16 am

Question1:
Assuming the Stamp 4 application was submitted while the Critical Skills Employment Permit (CSEP) was valid, and you have completed your 21 months of continuous employment, if the CSEP expires while the Stamp 4 application is being processed by the Department of Justice (DoJ), does the employee lose the right to work and require a bridging CSEP or reactivation employment permit to cover the processing time?

Question2:
Additionally, is it possible to apply for Stamp 4 in your 20th month of employment to account for the processing time, which is now over a month, by the Department of Justice?

Has anyone recently had their Stamp 4 approved while their CSEP/Stamp 1 IRP expired during the waiting period? thanks

The contract is supposed to be 2 years at least to apply for CSEP and there are 12 months in a year - in ideal world, you apply for Stamp 4 and have 2+ months left on your CSEP.
DETE used to say that you can apply at 20 month mark but it won't be processed until 21 months is reached; you can try it with ISD, but they might as well refuse.

There's no defined answer to this question that I have.
Technically yes, as CSSP is the thing that gives rigg to work, not IRP. How is it done in practice - not sure.

Ask your employee for an extra CSEP in advance if you wish to be safe.
