What qualifies as an Inter-company transfer?

Post by Saqib_R » Wed Nov 04, 2020 1:02 am

Hi, I would really appreciate your help with this.

Background: I have an LLC in the US. One of my key employees wants to move to Canada. I am committed to helping this employee get a work visa in Canada. I want to explore the inter-company transfer option. For this, I am opening a company in Canada.

Question: As far as Canadian immigration is concerned, does my Canadian corporation has to be owned by my US corporation? Or can the Canadian corporation be owned by me personally, and when it hires my US employee in Canada, could it be considered and satisfy the condition as an inter-company transfer?

The reason I am wondering as having my US business own the Canadian corporation would increase the tax complexities significantly. Owning it personally would be easier but I am concerned that Canadian immigration may not consider it an inter-company transfer.

Any light you can shine on this would be greatly appreciated.

Thank you.
