A case study: feedback welcome

1. An application for Tier 1 Genral was sent to UKBA on 15 Sep 2009.
2. Applicant claimed points for previous income before becoming full time student.
3. Applicant received a letter from UKBA on 5 Oct 2009 in which applicant is asked for clarification on full 5 year address history.
4. Reply to UKBA is given on 6 Oct 2009 about address history.
5. Application is returned back from UKBA on 14 Oct 2009 marked as invalid because of photos over 1 year old
6. Application fee refunded.

Since rules have changed on 1 Oct 2009 under new rules students can not claim earnings before starting full time studies. So according to new forms and new rules applicant is not eligible.

Does anything can be done about this situation or anything can be done to get this application considered under guidance published before 1 Oct 2009?

I would submit previous application form again along with UKBA letter of invalid application. :? . I assume that it is a similar kind of scenario, where applicant receives rejection letter after expiry of his visa. Several members on this forum got visa in the end, after expiry of their visa. The key is the reason to be addressed, and in this particular case, I think there is a reason: invalid application. So, as I said, I would submit again with previous applicatin form
