Chances of Getting a Job Offer

Hi there,

I am a Malaysian with degree and have appx 3 years' work experience in training & development as an executive. Travelled to uk previously on a working holiday maker visa and spent 2 years there. I am not qualified for HSMP.
My question is, will i be able to secure a job offer in which the employer is willing to sponsor me a work permit?

Any clue where i should i start with the job search? any job agency that is willing to send cv of a foreign candidate to their client?

Please help. Thanks

In order to get a Work Permit to employ someone it needs to be shown by the employer that they cannot fill the position from within the UK, or anywhere else in the EEA. (Unless the job is on a job shortage list, and that does not apply here.)

In my opinion it is unlikely that an employer would succeed in getting a Work permit to employ someone in the sort of work mentioned by you. Quite simply there are lots of people in the UK who could do that sort of work.

Except ... training in what? You were training people? Training them in what? Or were you being trained?

I am actually coordinating training program and develop new training programs based on my client needs. Most of these are BTEC programs with HNC/HND certificates. i had 1 year experience in lecturing in a college here (Management subject & English for Business). Will these help?

You can probably answer that better than I can. If an employer advertised such a job, what likelihood that someone could apply from the UK (or elsewhere in the EEA) who could do that job?

Indeed the employer does actually need to advertise the job. You would apply, and so might other people. If you are the only applicant who is able to do the job .... the WP could well be issued ..... but if there is another suitable applicant (legally able to work in the UK) then the employer would need to appoint that person, in preference to you.

When you say from anywhere else in the EEA, do you mean that the employer has to advertise the job vacancies in all the other EU/EEA countries as well or is the proof that there are no EEA nationals in the UK who can do work be enough?

John, many thanks for the link.

The wording still look a bit ambiguous to me. Does this mean that they can advertise the job in The Guardian and then justify that it is available throughout the EEA? Alternatively, ever heard of a WP being refused because of not being advertised in a media available throughout the EEA?

Does the same criteria apply to those on HSMP not meeting the new points scheme and wishing to switch to WP. I mailed H O this question and got a reply that all WP positions have to advertised first despite information from other sources that those on HSMP switching to WP would not have to go through the advertising criteria. The people who answer the emails to Home Office are junior executives and often contradict each other.
