Chances of winning appeal.

Post by a_mahla » Sun Feb 23, 2014 9:46 pm

Hi GURUS.

I applied for T1 ent visa as a team under 50k route on 11-12-13
Visa refused on 20-12-14. I was asked additional info twice.(additional contract & specific services provided by ur company). I have staff resourcing company. I have also submitted 5 contracts. Funds half in uk & ball in home country both in joint account with my team member.

I am thinking of oral appeal. THE REJECTION REASON IS "CONTRACT NOT VALID AS DOESNT MENTIONS THE SERVICES YOUR COMPANY GONNA SUPPLY TO YOUR CLIENT". NQF 4 condition not fulfilled so lost 75 points.

The contract had all the general terms like the remuneration My company would charge for placing a staff for a client & cancelation terms & how long it's valid for, what are clients rights & so on & so forth.

I was asked by UKBA the specific services I would provide to my clients as additional info & I have forwarded them the specific services I intend to provide to my clients as a separate page not on my contract.

Now my question is can I win an appeal. If I intend to go ahead.

Please gurus need your precious advise.

Thanks a million.

they probably refused you for not supplying the all information a contract should have(things mentioned in policy a contract should have). now pay attention such refusals are fell under evidential flexibility policy that they could have back asked you for the missing information in your case they did ask for the additional or missing information that you supplied and then a refusal is a scary part because they refused you having everything in hand.

to be qualifying working at level 4 or above can not always come through a SOC because every business has its own nature and ways of doing, you still score more than 50% winning chances if the services that you have(that you should have)provided clearly show you working at a level is a graduate level.
make sure you have provided(full or partly) services to your clients before the hearing will verify you working at level you were required at, doubt in working at level 4 otherwise(having all provided times 2) could not have been said on case worker part.
hope you understand what to do now
thanks,

Thank you for your reply.

I have given separate sheet along with my contract to all my clients too. But I just didn't included it in my contract.
