Change of employment application

Post by leeland3636 » Fri Mar 16, 2012 3:47 pm

I have recently been sponsored by my employer for the Tier 2 visa. In fact, I just had my biometrics 2 weeks back and my passport is still with the UKBA.

Since I submitted my application, I have found another job within the same company that I would like to move to. The new job is offering a salary increase of greater than 10%, but with similar responsibilities in a different area of business. My SOC code might change as it's in a different area.

My questions
a.) I'm not sure if this is a technical change or if this requires a new application.
b.) Will there need to be a resident market labour test even though it's within the same company?
c.) I'm not sure how this will be perceived by the UKBA, as I have just applied for Tier 2 and will be applying as soon as I received my passport again!

Please help!

Thanks so much

a)
if the SOC code is different for the other job then a change of employment application will definitely be necessary. See clause 190 of the Tier 2 policy guidance. Your sponsor/employer will also need to assign a new CoS to you
b)
the resident labour market test relates to the job, not the company.
c)
there is no rule as far as I know how many times one can change jobs on Tier 2 (General) but with the new application, if you need to make one, you might as well send a letter explaining the reasons/circumstances.
