Job in shortage occupation list with SOC 5434 and salary package is £29600. My question is can i go through RLMT process and diminish my package on same job code ?? Please suggest me

what are you thinking of applying for, entry clearance or leave to remain? If the latter what is your immigration history?

Hi Manci my visa was granted in June 2012 as a Event Manager after that I switched to sous chef in Jan 2015 which from shortage occupation list SOC 5434 and salary package is £29,570.
My query is
1. Can I go through the RLMT process ?
2. If yes then how much I can make my package ?
3. Can I diminish my package on same job code ?

If I understand correctly, you are asking if one could be paid less than the stated appropriate rate of pay if the sponsor agrees to do a RLMT for an occupation listed in "shortage occupation list" (SOL)?
So, do something that is not required in an effort to have the appropriate rate of pay lowered?


Explanation:
A job is in the SOL because of the (known) fact that suitable candidates are hard to find among the local labour force.

RLMT is required to prove to HO that a suitable candidate is not available in the local labour force hence the employer has no option but to sponsor a migrant. In the way of SOL, the Home Office is confessing that employers are unable to find suitable candidates from the local labour force so employers are free to sponsor migrants without a RLMT.

Answers to queries:
1. The employer may do a RLMT if they wish to, but jobs in SOL are exempt.
2. £29570 or above, after deductions for accommodation, meals etc.
3. No. (SOC code 5434 is listed in Table 4 but not in Table 9, hence 14(a) applies).
