Dear Moderator,

I am posting query on behalf of my sister in law.
Can you please help us out in child application.

Sister in law immigration history:
2009- came to UK as student
2019- became British Citizen by EEA Partner

When she came to UK she was married at back home and she divorced in 2011 (With Son-Current age is 12) and she married in 2012 again in UK to EEA Partner. She is British Citizen right now.

When she divorced with first husband she's got son custody in her favor.(Son lives in India and he is 12 year old now). Now she wants to bring son here in UK. when she went to Indian embassy in India to renew son's expire passport they told her son can not have Indian passport as She is holding British Citizenship. All passport office is refusing to renew son's Indian passport. Now they advise her that she can directly apply for son's British Passport in UK as son is still under 18 year.

In short they said when she became British Citizen son is automatically gets British Passport as he is under 18 now.
is that right? or is there any other way she can apply for Son application?

Please guide us or suggest us something in difficult situation.

Acquiring British citizenship doesn't confer citizenship automatically onto children born before then.
I believe child can be registered as British. Once registered child can apply for a passport.
