Child Benefit - Father and Child in ILR, Mother in WP

Post by malthiru » Wed Apr 14, 2010 11:26 pm

Hi,

Myself and my daughter (born in UK) have been provided ILR in UK from 1st April 2010. My wife is in UK in WP (no recourse of public funds) and hence we have not been able to apply ILR for her along with my application.

Wanted to check if I can now claim for Child Benefit for my daughter ?

Also Im looking to apply my wife as my dependent using form FLR(M) and after completion of 2 years apply for ILR using form SET(M). Both these form have questions relating to public funds ?

"Are you or your partner receiving any public funds? " and Child Benefit seems to be one of them ?

We all hold Indian passports.

Tnx

malthiru, have you read the first pinned topic in this Claiming Benefits section of this board? If not, please now do you. Given you now have ILR, that now applies to you and your family.

In short, no problem either you or your wife claiming Child Benefit, and the two of you jointly claiming Tax Credits.

Thanks very much John. So, in the FLR(M) and SET(M) forms do i need to check the box on receiving public funds and the one checkbox on Child Benefit, while making the application.

You will presumably be applying for the FLR(M) for your wife in the near future, so as a fact presumably there will be no benefit claims in place when that form is submitted?
