hi guys just asking on behalf of friend of my . married to someone with indefinite leave to remain who is student nurse and have two children one by him . my question is this: the fact that she is student nurse and has a bursary and also take child tax credit for the children will affect his application for marriage at the moment he is on student visa

She has ILR so is perfectly entitled to claim whatever benefits her circumstances dictate she is entitled to.

Whilst you have titled this topic "Child Benefit", you have not actually listed Child Benefit as one of the benefits being claimed. Please confirm that she is indeed claiming Child Benefit, and as regards Tax Credits, confirm that it is being claimed in the joint names of her and her husband.

Any reason why the spouse visa has not already been applied for? Have they just got married?

thanks for your quick reply she is claiming only child benefit .as to why he has not apply yet for spouse visa it is because he is afraid that because she received the bursary and the child benefit not the child tax credit as far as i know. once more thank you very much for your quick reply

Why are they not claiming Tax Credits? They are perfectly entitled to claim.

I don't understand why it is thought that receiving a bursary would cause a problem getting a spouse visa. Is it thought that the financial test might not be passed? What is their financial situation like?

my friend is student and only do part time job he is so afraid of losing his student visa in case the spouse visa is turned down as for the child tax credit i have just phoned him and he confirmed that his wife is also taking it.

No wait a minute, the Tax Credits claim, is it is joint names of the wife and the husband? If it is just in her name then that might amount to benefit fraud.

Again, what are their finances like? Is there a danger of the financial test being failed?

it is joint tax they both applied for the local authority is aware that they live together and also that he works part time job

OK, it is good that it is a joint claim, but in the absence of any numbers it is impossible to form an opinion as to whether the financial test might be passed or failed.

And all the time he is on a student visa he is limited to 20 hours work per week, whereas if he had a spouse visa that restriction would not apply.
