Hello,

I am a British Citizen and my wife is an EEA Citizen. Both of us have lived and worked in the UK without a break for nearly 7 years. My wife flew to Poland to deliver our baby there on 22/10/13. She has an S2 so it's all paid for by the NHS and she also gets her maternity pay from the UK.
My wife and the baby are still in Poland and are coming to the UK after new year's. My question is: can I now apply for Child Benefit or do I have to wait till my baby is in the UK?
Having read the government website I think I can't which is quite annoying as I have been paying taxes in the UK for 7 years and never claimed a penny. Is that correct?

Thanks. From this I gather that if I apply I have to proof that I am contributing to the child's upkeep. Do you think we would have a better chance if my wife was to put the application in her name? The child lives with her but they are not in the UK.
