Hi,

I want to register my child as a British citizen using MN1 form online.
The child (7 years) born outside the UK in 2017 and has ILR since 2021. The child has lived in the UK since 2017.
Father (Indian Citizen) obtained ILR in 2020 and the mother (British citizen) through naturalisation in 2024 (obtained ILR in 2021). Both residence of UK since 2016.
Only the child will be the applicant.

First and foremost is the child eligible to register as British citizen via MN1 form ?

I can see the following category in MN1 guidance: - which of them would apply.

Registration at the Home Secretary’s discretion – Section 3(1) application

Children applying in line with parents
Children will come within this category if:

one parent is a British citizen or about to become one through registration or naturalisation

the other parent (if involved in the child’s life) is a British citizen or settled in the UK (“settled” usually means that the parent has indefinite leave to remain in the UK)

the child has been resident in the UK for the last 2 years - (if the child is under the age of 2 we can accept a shorter residence period, taking into account the age of the child)

the child is settled in the UK

both parents give their consent to registration (unless good reasons are provided)

there is no reason to refuse on character grounds.
Children with settlement and residence
Children will come within this category if:

the child has completed a period of lawful residence in the UK of more than 5 years

the child has been granted settled status in the UK, and held that status for at least 12 months

the child’s parents have completed a period of 5 years residence and are settled in the UK (“settled” usually means that the parent has indefinite leave to remain in the UK)

both parents give their consent to registration (unless good reasons are provided)

there is no reason to refuse on character grounds.

Child can apply for registration "at the discretion" form MN1.

PS - The child is applying alone not with parents.

The application has to be under "at the discretion" form MN1 sub section of qualification would be: Children with settlement and residence and not under Children applying in line with parents

Am I correct ?
