About me:

Got my 2 year spouse visa Oct 2008 due to apply for my ILR round about September this year. I got a daughter who is still back at home, due to financial strain i have not been able to bring her but still planning to. My question is, suppose i am not able to bring her before i get my ILR, and i bring her after i have got my ILR, what VISA will i be applying for her in her in country? if am successful in bringing her, how long will it take before i apply ILR for her? or will wait for when am applying for my citizenship and include hers as well? pls advise me anyone

My hubby is british..never been with my kids dad. I got my child when i was in school so never been in touch. So my kids birthcerticate has only got my name.

After you are granted settled status (ILR) in the UK, you may apply for Indefinite Leave to Enter(ILE) for your child from his home country (297). The form to be used is VAF4A. See also visa application guidance Family Members (INF6).

For the ILE application to be successful, one of the many things you will need to prove is that you have sole responsibility of the child (as a parent) - through appropriate documentary evidence(s).

Suppose we manage ourself financially and i go apply for her now before i get my ILR, is it still possible or should i wait till i get ILR?

You may apply for Limited Leave to Enter with a view to settlement (301) for your child from his home country .. before you apply for ILR.

As mentioned earlier, you'll need to prove, amongst other things, that you are solely responsible for the child's upbringring (301(d)).

I think the same VAF4 is to be used for such application too but so check with the Visa Application Center or British Diplomatic Post nearest to you in your home country.

At least now i got a clue of where to start. And where i stand.

I have a got a file in regard to the above matter, gathering all the necessary documents including the sole responsibility.
