child born in uk under tier 1(g) before ILR

Post by ssem » Sun Jun 19, 2011 10:17 am

Hi
My wife is expecting a baby by november2011.
Since I am due to apply for ILR by Feb 2012, could anyone please advice on the following
A. Lead times to get the Indian passport done for the baby
B. Do I require to get the Tier1(g) dependent visa on baby 's passport or apply directly through an ILR application

Any suggestions or advice would be great help and highly appreciated
Thanks
Ssem

If not travelling, then baby born in the UK will be directly entitled to register for British citizenship, after a parent is granted ILR. No leave to remain application(s) required.

Dear Vinny
Thanks for the response. Could you please clarify if the baby requires to have an Indian passport first before applying for British citizenship using MN-1 form.
if not then, what would be the answer for child's current nationality in the under question "1.9 section-1 personal information" of MN-1 form.

and what other document would I require for the baby to register as a british citizen.

I don't think that a passport is required. If he's not Indian, then he's stateless. Include proof of a parent's ILR and baby's birth in the UK, etc.
