Child born in uk to unsettled parents section 3(1)

"Section 3(1) applications - children born in the United Kingdom to parents who are not settled in the United Kingdom and are not British citizens
Registration in this category will be at our discretion, if we believe it is reasonable under the circumstances and will be under section 3(1) of the British Nationality Act 1981. There are no formal requirements the child needs to meet providing they are under 18 at the time of application and are of good character if they are over 10 years of age. The application should be accompanied by as much evidence as possible to show us why the child should be registered as a British citizen.

Read this on ukba website... Daft question my daughter was born in the uk and I am currently on tier 2 general visa , expecting ILR in 2015 given rules don't change :( can I take a risk and apply for my daughter or did I just misread it ???

hi iam in similar situation you can read my situation

Dear All

I have query regarding MN4 application (Application for registration of a child under 18 as a British subject).



I have 5 year old son (born in July 2006) and he was born in UK but he have and I have Pakistani nationality(but not ILR In UK).

I am living with my son and I am separated from my husband (my husband do not have ILR in uk) and I have court order that custody of my son has been awarded to one parent (i.e. my name).
I have read MN4 application guidline and it indicate that if you are single parents and you have child custody order in your name and child born in uk you can apply for child british subject status.

So I have following three questions



(1) Can I apply for MN4 application for my son and can I include my application also in MN4 (For parents applying for British subject status at the same time as their child) and if it approve both of we get British nationality.

(2) I have only evidence from court order (that custody of the child has been awarded to one parent ) will this sufficient for MN4 application

(3) How much time it takes for outcome of MN4 application if I have court order for one parent.
