Hi Guru,moderator and all,

My daughter and wife are on PBS Tier-1 General dependent visa (before 9 July 2012).

Now, I have an ILR.

My daughter (who is 15 years) living with me since Oct 2011 in the UK .I included my daughter was in my application SET(O).

But, her ILR was refused under immigration rule 319 (J)(e)(iv), without right to appeal . She has valid visa until May.

When I made the application my wife was not present in the UK. My wife will join us very soon.I assume she will not have problem while entering the UK ,because now I have an ILR (correct me if I am wrong). My wife has not spent two consecutive years in the UK.She lived in the UK for about 5 months . I believe she is not eligible for the ILR.She needs to extend her visa using PBS dependent extenstion form(correct me if I am wrong).

I am seeking advices on the below listed questions :
Q.1 Will my daughter still be eligible for the ILR once her mother is in the UK as her visa was refused because her mother was not present in the UK when we made the ILR application?
Q.2 If my daughter is eligible for the ILR which application form she should use ?
Q.3 If my daughter is not eligible for the ILR now, when she will be allowed to apply for the ILR?
Q.4 If my daughter is not eligible for the ILR , she and her mother should use PBS dependent for the extension of their visa. And they will be eligible for the ILR only after completion of 2 years (correct me if I am wrong).


I would really appreciated your kind help if could answer my queries.
