Child of a Tier 4 student

Post by sbmowais » Wed Jan 11, 2012 11:02 pm

Hi
I am in the UK and my wife in India,We both have a valid visa for UK till Feb 2013. Applying this week for Tier 4 dependent visa for my daughter.
The law says-
(iii) where he is applying as the child of a Relevant Points Based System Migrant, either to him, to the Relevant Points Based System Migrant or to the child's other parent who is lawfully present in the UK or being granted entry clearance, or leave to enter or remain, at the same time;

Can my wife bank statement be used to support the application for my daughter as she already has a UK Tier 4 dependent visa. She is maintaining approx 5000 £ and I am maintaining only 1500 £. Can both the statements be taken into consideration altogether 6500 £ for our daughter entry clearance application. She was born in India.

I am studying MBA from Feb 2010 and had my visa extended in OCT 2011. I am on the the same course do I still have established presence in my case after my visa extension as I have not finished the course yet. The law says..

•He/she has completed a course that was at least six months long within their last period of leave, and this leave finished within the last four months;

If I have established presence now then I have to show only 1066£ for 1 dependent applying separately,in my account, is this correct

Also what does lawfully present in the UK mean.
