Childcare allowance for my daughter

Hi guys,

I have an ILR since October 2012. My daughter was born in the UK and is just over 3 years old now. However due to my wife's job, my daughter lives in India with her mother for the last 2 years. My wife was on dependent visa but changed to a student visa due to her sponsorship requirements for her studies in the UK. They are planning to visit me in the UK for 6 months.

Now my question is...will my daughter be able to avail 15 hours free childcare/pre-school in the UK ON A FAMILY VISITOR VISA?

No. Not as a visitor. But if you register her as British, she can, on completion of that.

As your daughter was born in the UK and you have ILR she is entitled by virtue of section 1(3) to be registered as British, this can be done on form MN1 regardless of where the child is. Thus, once registered your child will be British and there will be no restrictions or indeed need for a visa.

She is not entitled to have benefits claimed on her behalf while she remains on a visitor immigration status. Apply for her BC and she will be entitled.
