What's the particular concern, though? And where - on the UK side or US?

to be honest, everything, I wouldn't even know where to start, i've tried bunac's site for information but they have no information on marriage that I could see.

I've been told I would need some form of VISA before entering the US to get married, what kinda visa's / forms would be needed for my wife to come live over here.

Do you have any idea on time frame would take from applying for visa's to being able to travel, etc?

Well, what makes me slightly confused is that you don't plan to live in the U.S. afterwards.

Being a UK citizen you could go to US visa-free, get married and then come back to UK with your spouse - no US visa involved. She would need to get the appropriate status to live in the UK, but that's another story.

The only time you'd need a visa is when you definitely want to get married, and you plan to remain in the States afterwards. Then you'd apply for K-1 fiance visa, come to US with it, and you'd be expected to get married within 90 days of the entry. Following that, you could apply for adjustment of status to that of a Permanent Resident (Green Card) and wait for that to happen in the U.S. (with work rights 90 days after the application), OR you could be processed in the UK.

Hope I answered your query at least partly.

If I understood you correctly, and you do plan to live in the UK afterwards, I'll move this topic to the UK section - look for it there if you don't find it here.

You pritty much answered the questions, to clarify..
I don't plan to live in the US, but either does my fiance.

I guess, I need to look into a K-1 visa to get married over there, then, what would I/we need to apply for, for my fiance to beable to live and work in the UK?

Do you know of what time frame it takes, to get a K-1 visa?

Andy, once again, you don't need to apply for any visas if you have no plans to stay in the States. You could visit your fiance, get married, and then she'd apply for entry to the UK as your spouse. I think an in-country switch is also possible for her as a US citizen, i.e. she simply travels to the UK with you without a visa, and then applies for change of status.

Hope this helps.

Hiya,

I don't think US citizens or anyone for that matter can easily switch to spouse status once in the UK. The best approach would be to marry in the US (no visa required as you don't intend to stay there) then go to a british consulate in the US and recieve a spouse visa for your partner (http://www.britainusa.com/visas/other_show.asp?SarticleType=25&Other_ID=322)
Then you can travel to the UK together and your partner can take up work from day one. Otherwise if you marry in the US and come to the UK together with your partner she will be denied entry. The immigration officer will ask your american partner what is the purpose of their visit to the UK. If they answer 'to visit friends etc' they would be lying and guilty of immigration fraud. If they answer 'to reside here with my parner' they will be asked for their spouse visa. Most nationals from outside the EEA who are coming to the UK to take up long-term residence (longer then 6 month) must have the relevant visa and entry clerance from the embassy. British immigration can be very understanding at times so there is some chance that your parner would be given some sort of limited leave to enter and apply for a spouse visa in the UK, but it is just as likely she would be denied entry and sent back to the US on the first plane.

Take care,

bonzo
