EU citizen and naturalisation

Post by eliasuk4u » Fri Apr 04, 2008 8:38 am

Hi,
This post is on behalf of my friend who is EU citizen living in UK since 1998. He got his residence permit (which is for 5 years) but not ILR.
The question is, Does he have to have ILR before he can apply for naturalisation?

No he doesn't have to have ILR, but he does need to have PR .... Permanent Residence .... and based upon what you have posted, he already has that, automatically, on 30.04.06, when new EU regulations came into force. So to apply for Naturalisation, he needs to have that PR status for at least one year, and he has complied with that.

But he does need to pass the Life in the UK Citizenship test before he can apply.

In what way has he been exercising his EU Treaty Rights in the UK? Working? Studying? Or what? Finally, what nationality is he? Just checking if he has been an EU Citizen for at least 5 years!

Fine, subject to him passing the Life in the UK Citizenship test, he can apply, but should make sure that when he does apply that he was in the UK exactly 5 years before BIA will receive the Naturalisation application.

Also, when he does apply he will need to supply proof that he has been exercising EU Treaty Rights in the UK for the past 5 years. Payslips/P60s will tend to prove that.
