EU-citizen married to a non EU-citizen

EU-citizen married to a non EU-citizen

Can anybody help me with some information? I am a hungarian citizen, my boyfriend is from Uzbekistan. We would like to get married and settle down in UK. I am right now in Hungary, he is in Uzbekistan. Where we should get married? In Uzbekistan and then apply for a visa for him as a spouse of a EU-citizen? Should I already be there in te UK with a permanent job and address for him to be able to apply? Or it doesn't matter that I am not already there? If anyone could answer my questions I would really appreciate. :D

You need to be exercising treaty rights in the UK, so working/studying for 6 months before you are considered to be exercising them.

So we should get married in Uzbekistan and I should spend at least six months in the UK before we can apply for him to join me?

Get married wherever you want to, that's a decision for you and your partner.

If you want him to join you in the UK then you will need to be working or studying for at least 6 months in the UK in order to be exercising treaty rights.

Is it also possible that we get married in UK, it would be much easier because of the language and translations of the certificates. But if he applies for and gets a tourist visa let's say which is for 1-3 months, and we get married within these three months, will he have to leave the country after his visa expires? Or how he could come to the UK to join me?

You can't get married on a tourist visa, you would need to apply for a marriage visa and he would have to leave afterwards as it is literally only for getting married in the UK.

Okay, so as far as I understand the best is to be already married (in Uzbekistan) and then when I am already there in the UK for a while, then we can apply for him to join me? And what is that visa called?

Some EEA visa, not too sure of the exact name as it's not a UK visa.

I'm not 100% sure but 99% sure that he will be able to yes.

Why on earth you want to be in the UK right now i genuinely don't know but that's your decision.

We were living together in the US. And now the other option would be for him to to come to Hungary and it is not easier at all. But I don't want to stay in Hungary for years, and UK would be better for him because of the language and the work. That's my point of view, well there are other european countries as well, but UK is the country where I can live and work freely without having to apply for work permit and residence permit. Maybe you know more about these things that's why I was sharing this in the forum.

Get married, then he applies for an EEA Family Permit, which is valid for 6 months and enables him to work.
You don't have to have been working or studying in the UK already, just by moving to the UK you are "exercising your treaty rights" as an EU citizen, and he is entitled to accompany you as your Family Member. Best to have some plan for getting a job or supporting yourself here, because if when he applies for a Residence Card (valid for 5 years) you can't show that you are a worker or have a realistic chance of getting a job, they might refuse to issue one.
But then, if you're here for 6 months and can't find a job, why would you want to stay? - unless you are rich enough to support yourself without working, in which case you must have private health insurance.

Hungary is an A8 country for which there are still some special rules in effect for workers. Have a look here and pay particular attention to the Worker Registration Scheme.

Ok, so if I go to UK, I have to apply for WRS and he would be able to join me only after one year, or it's still the same: any time? And if he gets there, he wouldn't be able to work right away?
