EU Citizen planing to move to Ireland with boyfriend

Post by suecobrasilien » Sun Feb 04, 2024 11:33 pm

Hello
I have been reading about the rules to apply for residency for my boyfriend in Ireland and I am a bit confused. It says that you need to be either married, on civil partnership or having had a stable relationship for 2 years.
We have been together for less than a year. Does it mean that his only chances of getting residency is that we need to get married, preferably before getting to Ireland given that they dont seem to consider a stable relationship if it lasted less than a year...

Basically yes - either marriage or 2+ years of cohabitation (de-facto) is considered; the latter might also be highly scrutinized.

Thank you. What about civil partnership that has taken place before getting to Ireland. Will that put the non EU citizen in the same category as spouse?

*****Civil partnerships registered abroad since 16 May 2016 are not recognised as civil partnerships in Ireland.

Couples in a civil partnership can apply to marry or remain in a civil partnership. If they marry their civil partnership is automatically dissolved.

Thanks I ve read that information on the page that applies to Irish citizens bringing their non EU partners to Ireland. However and confusingly in the Imigration part of Ireland's EU treaty page it says:

https://www.irishimmigration.ie/coming- ... ty-rights/

"If you are in a registered civil partnership with an EEA national, you should apply on Form EUTR1. Recognised civil partnerships are treated the same as applications made of the basis of a recognised civil marriage."

Is it different for Irish citizens?

***you can no longer register a civil partnership in Ireland. Couples already in a civil partnership can apply to marry or remain as they are.

So you can apply for EU treaty rights as a civil partner of an EU citizen.

It's same for Irish citizens but you can not apply for EUTR if you are Irish and have never lived in another EU country with your civil partner.

Civil partnership in this context is same sex marriage (before it became legal to have a marriage. Doubt this is your case.
