claiming benefit on ILR , effect on BC?

Hi everyone,

i recently have got ILR, my and my partner before i was on Tier 1

just wanted to know, if i claim benefits (like child benefit, hosing benefit, tax credit etc..) is that gonna effect on my application when i will be apply for BC?

You can claim without it affecting your BC application as you are no longer under Immigration control.

one more question i think i have read in this forum already just wanted to confirm...

my wife came to uk in May 2012, thats why she got the ILR with me, but for BC application one of the requirement is to live in UK for 5 years, i am living here from last 10 years so next year i'll be eligible to apply for neutralization, but my wife would not ? right?

and as soon as i attend the ceremony, she can apply for Neutralization? even when her 5 years in UK are not completed yet?

am i correct?

As soon as you have BC your wife will be able to submit her application.

sorry one more question :)

my wife has done PAT (Cambridge) test before April 2015, which was on the old list, can she use the same English certificate at the time of BC application ? or does she has to do it again from the new list ?

There is a transitional period but if your wife's test is on the list in the link I've posted, she will need to re-take the B1 Level test. This is from the UKVI guidance:
"These tests can be used in a UK immigration application until 5th November 2015 only when they have been taken on or before 5th April 2015."

we are planning to go for Holidays back home (Out of UK) in November, i will be back in 1.5 months but my wife wanted to stay longer for like 3 to 4 months , we are going to vacate the property (1 bedroom house) we are renting, and once i get back i am planning to rent a 2 bedroom house, so is that going to effect our benefits ?

secondly, what effect it is going to make on our future neutralization application?

if you a limit of 90 days permitted absences in the last 12 months before naturalisation.
