Child Benefits for Child lives abroad

Hi,

I have a British son who lives abroad (Iraq) with his mother but I am responsible and provide for them

Can I claim Child Benefits for him?

I live and work in the UK.

No. The child needs to be living in the UK.

Hi
My sisters child has a British passport but lives in South Africa. The father to this child lives in UK, yet he is allowed to claim child benefit for the child. Ofcourse before approving it the benefits office had to get documents from the mother etc. So maybe find out from the respective office

It's benefit fraud. The child needs to be living in the UK.

Oh gosh really, I didn't know its fraud he is doing. Has it come to that. Anyway atleast I know. I wont encourage it.

It's NOT benefit fraud and you CAN get child benefit for a child living outside the UK. It's under EU law.

EU law doesn't apply to South Africa.

That's true.

With the DWP (who already deal with nearly all the benefits) now being given the powers to take over HMRC benefis for prosecution, they will likely be more active at catching HMRC benefits fraudsters. The DWP already have the powers if they only suspect fraud, such as looking at bank statements,. They also use the credit agencies to do a sweep and look for UK credit footprints of claimants.

The UK beneftis are limited to just some in the EEA. But Universal Credit that replaces six other low income benefits, has been designed so that it is not payable in EEA countries and that includes to British citizens liviing in those countries. These will have to claim from the EEA country they live in.

And we still don't know what will happen if there is not trade deal.

You're confused. AS you yourself quote, that is about when YOU are living abroad, and claiming CB. The question was about the CHILD living abroad and the parent working and living in the UK

It's you who are confused. Read the quotes again. The question has been answered and they cannot claim benefits for children from the UK as the child/ren is in SA.
