Claiming Benefits - Spouse of EU citizen

Post by Johura » Wed Jan 22, 2020 11:48 am

I was wondering whether a spouse of an EEA citizen can claim benefit - she has the bpr/residency card and she will soon apply for settle status too.

EEA citizen wants to leave the country/separate but spouse will be staying in UK with the kids.

any advice please on whether she can claim benefits and reside on her own ?

If the spouse has PR or settled status, yes. Without, she would have to show that the EEA National spouse is exercising treaty rights or she has a derived right as the primary carer of an EEA Worker child in general education.
