Hello

so my relative has just gotten her british citiznship last month. she has a kid here and has been claiming universal credit as single parent for her son.

she's just going to get married to her partner and try to bring him over on spouse visa.

The queston is pls

does this mean she has to stop claiming Universal credit if her spouse will be here?

and if she has to stop,

should she stop her universal credit before his application or it shoudl be stopped when he gets the visa?
shes working by the way wth a salary of about 31k, so just getting top up from UC and childcare costs

Has she honestly declared her income of 31K to authorities? If yes and still getting these funds then shouldn't have any issue because £18600 is the financial requirement assuming the child is British.

yes, universal credit takes into account Real time information so hmrc reports directly to them her wages every month and then she gets a top up on that ..plus childcare costs

the issue is she's not sure if she has to stop getting the benefits before applying for her partner or stop when he comes in.

So not sure if she sstille ntitled to it if her spouse comes over

I imagine she has a high rent. Claiming UC doesn’t preclude someone applying for a spouse visa. When the spouse arrives the UC should continue until such times as the spouse/you have earnings or capital that exceed your UC allowance.

she said an immigration lawyer told her that she has to stop it before making the application.

The thing si she cant stop now because of childcare costs support.and definitely the idea is for the spouse to start working immediately he come sin , but we know thats not going to be immediately

so its confusing now what the process is
