Universal Credit claim with a partner who cannot have UK Public Funds

Post by JB007 » Sat Jun 13, 2020 11:52 am

For those asking how to claim Universal Credit with a partner who cannot take UK Public Funds-

Guidance
Universal Credit: further information for couples

Updated 6 April 2020

1. Definition of a couple

The Department for Work and Pensions counts 2 people as being in a couple if they live in the same household and are:

married to each other
civil partners of each other
living together as if they were married

2. Claiming Universal Credit

If you are part of a couple you and your partner will need to make a joint claim for Universal Credit.

You begin by creating a Universal Credit online account each. The first person to create their account will be given a partner code, which will be displayed on screen.

This code will need to be input by your partner when they register for their Universal Credit online account. This ensures the accounts are joined together and you are correctly claiming as a couple.

Once you’ve created your account a claim can be made for Universal Credit. You’ll have 28 days from creating the account to make a claim. You should aim to complete the application as soon as possible to get your claim started.

If 28 days pass and a claim is not made you’ll need to register for an online account again.

If one of you isn’t eligible, their capital and income may still be taken into account.

It is the responsibilty of the claimant to ensure their claim is correct when their UC is set up. Check that there is no extra benefit money being given for the partner who cannot have Public Funds and the DWP have correctly applied the claim as one partner not entitiled to Universal Credit, but that their capital and income is part of the claim (reduces the amount of benefit money paid).

Mod - please add this to the sticky Universal Credit claim with a partner who cannot have public funds.

Would a Mod please add this article to the sticky Universal Credit claim with a partner whjo cannot have public funds?

Article origianlly linked on this board by Mod Amber to show the problems of being a joint tenant and Universal Credit, it was updated on 14 December 2021 with different scenarios when a claimant has a NRPF partner.

The article now also address the problems of claiming Council Tax Reduction (public fund) with a NRPF partner. Council Tax Reduction is not part of the Universal Credit welfare benefit: Mods might want to change the name of the sticky?
