Hey

Hypothetical question: An Irish person comes to the UK to look for work, but is unsuccessful in the short-term. He applies for jobseeker's allowance as soon as possible (anyone know how soon this is? Is it directly after entry to the UK or does the 3 month habitual residence rule apply?) and continues to look for work. His non-EEA wife them comes to the UK to join him and he finds a job (no need for JSA anymore).

Question: If, after he gets some pay slips together, his wife applies for EEA2, will they be disadvantaged in any way by the fact that he claimed JSA in the past?

Irish citizens are not subject to immigration control, albeit same as other EU citizens, the Irish have a special status, they are considered settled up on entry into the UK, a status that is more favourable than ILR, habitual residency test will not apply, you must have already known that claiming benefits does not affect EEA applications.
