Claiming JSA/HB and impact on ILR

Hi,

I am married to a british citizen and due to apply for indefinite leave to remain in early 2010.

I work fulltime but my wife is not working and depends on me.

About 8 weeks ago, we had an argument and my wife left and said she was going to her sister's, who claims JSA and HB in London. I have recently discovered that my wife started claiming JSA as well as soon as she arrived in London but never told me, as she had cut all communication with me, the moment she left our place. So she has been claiming JSA and HB/CTB now for over 8 weeks. We are trying to settle our differences and she has informed me that she has stopped claiming the benefits, although we are still awaiting proof of this from DWP and the local council.

My question is, for the fact that she has claimed benefits for the period stated above, will this affect my application for indefinite leave to remain come 2010, even though she has now stopped claiming the benefits?

She was getting just over £90 per week. If we were to pay back the amount that she claimed, how would this affect my application for settlement?
