claiming legal aid

Hi my partner is a over stayer he was married to some one else but the marriage broke down he now wants to have a divorce. we have been told that because i am in receipt of income support he may be able to get legal aid. Also because he came here on a 6 month vistor visa in 2002 his passport was'nt stamped with no recourse to public funds, we also were advised because its not been stamped he may be able to to get legal on that ground also. Could someone pls advise me as to weather any of this is true. We really don't want things like this to hinderer him applying for his application later.

Legal aid does not count as recourse to public funds.

Hi Greenie thanks for your reply do you have any idea if he will be able to get legal aid for his situation. Do you know what the critrea is to legal aid?

Are you talking about legal aid for his divorce or his immigration matter.

I was talking about the divorce, but would it be possible to get legal aid for his immigration matter also.
