Urgent Assistance Required – Visa and Right to Rent Issue

Dear fellows,

I am writing to seek urgent advice regarding my wife's visa status and right to rent in the UK.

I have recently been granted Indefinite Leave to Remain (ILR), but my wife's visa is due to expire in April. However, when I checked her eVisa status online, it incorrectly stated that my visa had expired, which is now affecting my wife's ability to provide proof of my right to rent to my landlord.

As a result, my wife is currently unable to obtain proof of a valid Right to Rent through the government’s online system. This is causing issues with her tenancy, and I am concerned about her legal status in the UK.

I would appreciate your guidance on:
  • Correcting her eVisa status to reflect my ILR and her current visa validity.
  • Providing a right to rent evidence to our landlord.
  • Her visa extension or switching options before her current visa expires in April.
Please let me know how we can proceed and whether you require any additional information.

Dear Fellows,

I am writing to seek your advice regarding a visa matter.

I previously posted my query titled “Guidance on ILR, Dependant Visa Extension, and Newborn Child Citizenship Application”: https://www.immigrationboards.com/viewt ... 2#p2185567

According to the guidance, I was to wait for my wife’s visa to expire before applying for an extension. However, I recently checked her eVisa and discovered that it had already expired. I learned that although her visa was granted in April 2022 for a three‐year period, my GTV visa expired on 20th February 2025, and consequently, her visa expired as well – a fact we were unaware of.

Subsequently, I posted another query titled “Urgent Assistance Required – Visa and Right to Rent Issue” and reported the error. The response we received was: “Unfortunately, we are not able to make any amendments to your eVisa as this leave has now expired.”

I am now in the process of applying for her visa extension. Could you please advise whether this situation resets her ILR clock, constitutes a criminal offence, or if there is a fine imposed for the overstay?

Your guidance on this matter would be greatly appreciated.

You claimed this was an error but it turns out that you made a mistake and failed to notice that her visa expiry was in line with yours. It has been less than 14 days so paragraph 39E applies, just apply for an extension NOW !!!

It has no effect assuming you apply within 14 days of previous visa expiry and hee visa is later granted. That is the whole point of paragraph 39E

Thank you for your response. I submitted her visa application on 1st March and completed the biometric verification on 3rd March, within the 14-day grace period. I hope her visa is renewed without affecting her ILR clock, in accordance with the law. Fingers crossed!
