Close to ILR App and moving from perm to contract

Post by r2d2 » Tue Jun 14, 2011 5:35 am

Hi,

I am a software developer currently in Full time employment. I am on Tier 1 visa and due to apply for my ILR in Sept 2011.
My situation is as follows:
I am looking at potential contract opportunity which is better in work and in money. The contract is for 3 months initially with possible extension.

For ILR , I have gain enough earnings from my perm role to score 75 points. (not grater then last application but enough for ILR points).

My question is , is it wise to move from Perm to contract now or should I wait out. I have read on this forum where people had problems when didnt had perm job?

Any opinions are welcome. Many thanks in advance for helping me out on this.

You should be OK. As long as you are in employment at the time that you apply for ILR than your application should be easy.

Thanks for the reply. However if I dont have a contract at the time of application but being a director of a Limited Company and looking for new contract, will it be suffient to prove that I am economically active?

You need to satisfy the CW that you are economically active. There have been recent cases in this forum where the visa holders were out of work when they applied for ILR and were successful at it.

I think UKBA realises that not everyone can be fully employed all the time - not even for migrants - especially given the economic situation!
