Cohabitation SET[O] statement

Post by myilr » Fri Sep 30, 2011 12:37 pm

Dear All,

I just want some clarification regarding the cohabitation thingee.
I am eligible for ILR in Dec 2011. I extended my Tier1 (with my dependants) in July 2011. Based on the statement below (from SET[O] form) am I right in understanding that I need to show cohabitation documents only from July 2011 and not actually for 2 years.
Just wanted to make sure I am doing the right thing.

Anybody else has experienced same thing?

Thanks very much for your help
If you have a spouse or civil partner listed in section 2 of this application form who is applying at the same
time as you, please provide documentary evidence of cohabitation since you were last granted leave (up to a
maximum of two years). Evidence provided should cover the whole period and be in the form of official letters
or documents, addressed to yourself and your spouse
Regards..

Cohabitation documents covering (at least) 2 years preceding the settlement application.

It's confusing in your case as you have made three applications in a work category that leads to settlement, rather than the usual two, to complete five years. The question is general and directed at the majority and assumes that an applicant's last grant of leave was two or three years ago. The immigration rules expect that dependants applying for ILR have lived in the UK as your partner for two years so you should provide a spread of documents covering a period of two years.

Thank you both.

Lucapooka, I initially came to UK(Dec 2006) on WP and then later on switched to Tier1. But my 1st Tier1 was not enough to cover the 5 year period, so I had to extend it in July 2011.

I wonder why they can't simply say max. of 2 years.. instead of the additional clause of "last granted leave".. makes things more confusing.
