Complication Case: PLEASE HELP

Post by hsmpinaction » Wed Sep 22, 2004 10:20 am

I filed HSMP in Aug 2004. Still awaiting decision. I am currently in UK on a work permit which expires on 25th Sept2004. I will be done with my current contract by then and my employer is not interesting in extending my work permit. I am an Indian passport holder and have spent more than 3 years in UK(due for FLR in June 2005).
My questions are:
1] Can I still remain in the country legally after 25th Sept 2004?
2] Can I work for another employer while I am waiting for my HSMP decision?
3] Can I(Should I) file an FLR without HSMP approval letter? THe FLR form says you should have HSMP approval letter attached. Since I am not expecting a HSMP decision before the end of this year, what will be the outcome of my FLR application? Or my FLR will only be decided when my HSMP decision comes through?
4] Should I just wait for my HSMP decision(remain in UK)and not file an FLR now?

I am into IT and it is very difficult for me to find an employer who can sponsor a work permit for me. However, if I get HSMP, I can find work and reamin in the country and eventually get my ILR in June next year.

Anybody in a similar situation, please share your experience.

Please help.

To my knowledge ...

I think u have to wait for the HSMP decision and mean while u can try applying for jobs who knows u may find another employer who can sponser work permit ... but u should not work for another employer ...

You can stay legally until u get a HSMP decision.

ND,
Thanks. But remember, you can apply for a FLR only when u have a valid leave to remain; that means, I cannot apply for my FLR after 25th of Sept until I get another employer to sponsor me and I am on a valid WP again.
So, I really don't know what to do.

ND, you are right. I can continue in the UK legally. But I will not be able to file a FLR(assuming a get a positive HSMP decision) because I don't have a valid leave to remain(assuming I don't find an employer to sponsor me before my HSMP decision comes through).
does it make sense?

ND,
No, that is not the case. This is all about the timeframes we are talking about. It is an indication that you will file your HSMP well before your current leave to remain expires. But in my case, it was too later. I am not expecting a decision before the end of this year.
What if I send my passport for FLR now itself? before 25th.
What do you think would be the outcome of my FLR application? Or it will just remain with them until a decision is made on my HSMP application?
FLR is taking about 5 to 6 weeks at the moment.

Any other experiences please.
