A concerned friend seking information, please help??

I am seeking advice for a friend of mine that is currently confused, he has been in this country for almost 14 yrs(October he will be 14 years in this country). When he spent 9 year, he applied for HSMP but was refused, the home office replied 8 months later. by this time it was only 4 months left to become 10 years resident. When his refusal letter had arrived his visa had already expired that's because home office took too long to reply. He then applied for indefinite residency which till today he hasnt got a reply from the home office.

he is due to marry a beautiful lady who is british , but he is confused and does not know what to do and he wants to move on with his life.

please help

If he applied for ILR (Long residence), four months before completing his 10 years qualifying period, then it may have been too early. Did he appeal against his HSMP refusal?

If he was served with an IS151A/B his 14 years will not count in any case. As for marrying a Brit has he got approval from the Home Office to do so?

No, he didnt appeal against his HSMP refusal, he had only 4 months to complete his 10 year stay, so he decided to apply for his 10 years. now it is getting to his 14 year and the Home office has had his passport for 4 years.

He wasnt served with IS151A/B,. What is IS151A/B?

It is a notice that basically sets out the illegal status of an individual subject to immigration control. In the most simple terms it states you should not be in the UK and that you are liable for removal. The notice also stops the clock for any ILR claim. If he was served with an IS151A at his 10 year claim point - getting to 14 years is meaningless as the time does not count.

And even if he was issued with it without his knowledge...
