Concerns regarding the 90-day rule within the past 12 months.

Post by stef-steca » Mon Jul 28, 2025 2:20 am

As an Italian citizen, I am in the process of applying for British Citizenship.
I fulfil the following criteria:
- I was present in the UK on the initial day of my 5-year qualifying period.
- I have not exceeded 450 days outside the UK during my 5-year qualifying period.
- I have not been outside the UK for more than 90 days in the last 12 months.

I am unable to locate any stipulation indicating that I must be in the UK on the first day of the last 12 months.

I wish to submit my application at this time; however, I was in Italy during the same period 12 months ago.
It's not an issue for the Home Office isn't it?

Thanks in advance
S

Concerns regarding proof of residence in the UK over the past 5 years.

Post by stef-steca » Mon Jul 28, 2025 2:35 am

I am an Italian citizen applying for British Citizenship.

During the last five years, specifically from March 2021 to August 2022 (approximately one and a half years), I was not employed as I dedicated this time to enhancing my skills. In summary, I completed three online courses and obtained two certifications, with the third certification acquired in 2023 while I was employed.

I have documented all my travels outside the UK over the past five years having spent less than 450 days abroad during this period and fewer than 90 days outside the UK in the last 12 months.
However, I am unable to provide additional proof of residence in the UK for the above period of unemployment, as my courses were conducted online.
I have not encountered any restrictions regarding employment or unemployment during the 5-years qualifying period. I have never applied for any benefits and am capable of supporting myself through my own income.
For the remaining duration, I possess letters from my employers.

Is it possible for the Home Office to deny my naturalisation application due to the period of unemployment mentioned above?
Is it possible to clarify the duration of unemployment in a cover letter?

I understand that bank statements and utility bills are not regarded as valid proof, could I submit any other forms of evidence?

Thanks in advance
S.

Apply for a basic SAR with UKVI https://www.gov.uk/government/publicati ... mmigration

Or provide letters from the NHS, DVLA, HMRC (no printouts from websites or screenshots) from that time period.

Unemployment is not an issue per se, but you must provide some accepted proof of residence for that 18 months period, or else your application may encounter issues.

It is not a requirement to be physically in the UK on the day 12 months prior to the application. However note that as I answered in your other thread you will need further evidence for the initial part of your qualifying period. Please keep your questions all to one thread.
