Consequences of renouncing UK citizenship if UK leave EU

Post by rdmt18 » Fri Aug 07, 2015 12:27 pm

Can anyone offer any advice. I am just about to send off the forms to renounce my British Citizenship so I can bring my spouse to the UK based on my Irish nationality and the right of free movement.

However I have worries about the long term consequences of this in Regards to the UK leaving the EU, and what that would mean down the line after the expiry of RC. As this is a big decision and after doing this I would hope be without worry of being separated from my partner again in the future. So for that I am worried about what would happen. Would we need to leave the UK? If so could we move to Ireland using SS having exercised treaty rights in UK? Is it possible to reclaim British Citizenship again in the future?

It is possible to do so. See Section 13 of the British Nationality Act 1981 (at http://www.legislation.gov.uk/ukpga/1981/61/section/13). It appears that even if you don't meet the requirements of para.1(b), you could still apply under para.(3) for an exception. I have a friend who renounced his BC for reasons other than those listed in 1(b), but the HO advised him he could still get it back if he wanted it.
