Hi Everyone,

As most of you know I have won my appeal but judge asked HO for reconsideration. It has been over a year I have been waiting for my passport during this time I have lost my father I couldn't even go to attend the funeral.

Now although I won my appeal I have no idea how long more It will take. I asked my solicitor to send them a letter which he did but he told me if they don't issue visa within 8 weeks we will take them to High Court for contempt of court.

I don't really know what to do.

Any suggestion or advise will be appreciated.

Allowed appeals in this visa category focused on the grounds they used to refusal your application that means Home office still needs to be satisfied with the other grounds (paragraph h of the immigration rules) that also means court can not force home office to issue you a visa when court matter relevant to your appeal is not disputed no more as appeal is allowed.

in your case the minimum waiting time before home office should be written informally about the case is 6 months, if it has been more than 6 months since your appeal allowed your lawyer did a good job by writing them latter but if you are within less than 6 months time since appeal allowed then no informal ways asking but there is no harm if you phone them to take update on your case formal ways.

there can not be a Grater sorrow than loosing your loved ones MAY HE REST IN PEACE but unfortunately there is not much one could do to make this process quicker

I am the who is also waiting for an update on her case after a withdrawal on original decision took place back in Oct.2013.as there has not been no news since

what I said in my previous post is said by my lawyer and I read it myself to confirm and is true, whereas MP it could give a push but you should ask for it once 6 months gone passed, as I said in my last post there has not been anything that could firmly affirm worked as a wake up call Home office woke up on.
