Cos states salary 37K, can I be offered higher basic salary

Cos states salary 37,750. Can I be offered basic salary of 39,300. RLMT did not had any salary range. Salary was mentioned as 'competitive'.

I recently got Tier 2 general visa in last December 2015. As I was working for the same employer on the dependent visa I got the hike which was due in January. I am allowed to get hike, or higher pay.

If you've already received the Tier 2 visa in Dec and you've already rejoined, the hike now is fine. People do get hikes in their career which is fine. However, if the offer which your company gave you to join them for this Tier 2 role is different from what is mentioned in the CoS, then its not allowed.

Thanks for the reply. I did not get any formal offer letter after joining as Tier 2 general candidate... I just came back and continued to work as normal on the same salary, as I said I was working for the same employer on dependent visa. Is that a requirement to have a formal offer letter?

I understand. However, on paper you are a new employee who has joined after necessary Tier 2 visa clearance. I'm not sure how your organisation handles or want to handle such cases. However being a A-rated sponsor, they are required to maintain necessary documents for home office inspection (whenever it happens). And I personally think that an offer of employment may be required for a new hire.
