Counting 5 years for naturilization application

Post by ushab » Mon Nov 23, 2015 11:03 pm

Hi,

Myself and my spouse are applying for naturalization next month. We have had the ILR for close to 2 years now.
I have booked an appointment with NCS for December 4th. But I have been just informed by a friend about a rule which i cant find in any UKBA articles.

Basically what I have been told is, if I am applying on the 4th December 2015 then on 4th Dec 2010 (5 years ago) I should not have been outside UK.

we have returned to UK on the 11th Dec 2010 from vacation and were very much in the UK on 11th December 2010. My question is, if the above rule is true, am I eligible to apply on 11th of December 2015 or should i wait for 2-3 more days?
I tried to find out from NCS customer service but they refused to provide any information.

Any information on the above will be greatly appreciated.

Thanks, Ushab

That's correct - it's all detailed on page 8 of the guide AN which you should read thoroughly before submitting your application.

https://www.gov.uk/government/uploads/s ... r_2015.pdf

Only apply one you meet this criteria as they usually reject your application if you don't which would lose you quite a bit of money :/

Yes, you may apply on 11-Dec., since you landed on UK soil on that day (after your absence). To be on the safe side, apply on 12-Dec or later.
Life isn't fair, but you can be!
