Our In-Country Appeal against Removal Order following has been submitted. Please can you advise us on what to expect if this is refused.
I am UK citizen and my partner is from Algeria; we applied for visa 10 year route as partners (appendix FM), this was refused. We subsequently submitted an appeal against the Removal notice this week. My partner has been in UK without legal visa clearnce since 2002.
We have been living together as partners in my house since 2011, the last two years has seen me suffer drastic illness eg multiple bloodclots on lungs plus have now become disabled as a result of rheumatoid arthritis which prevents me from travelling.
HO had refused visa on grounds that I could relocate to North Africa and for us to apply for visa from there.
Our solicitor has submitted evidence of my illness which they claim constitutes 'insurmountable' obstacles to joining my partner overseas. Plus evidence of our joint cohabitation/responsibilities to prove us being 'partners' as defined by appendix FM.
AS my partner does not have joint tenancy/council tax as property is in my name on the title deeds we only have 1 x water bill in joint names. My partners name is listed on the gas/electric and tv licence. Plus a selection of letters from our neighbours and friends to support that we are in a genuine subsisting relationship. Finances are not an issue but he has no bank account or any other utility bills. Only GP letters/hospital letters etc.
My GP and consultant have previoiusly submitted reports clearly stating that my partner is living with me plus being registered at the same GP in addition to being my 'Carer'.
The solicitors aim is for the HO to accept that we are 'partners' as defined by appendix FM and to be granted appeal at first tier tribunal.
In the event that the appeal is refused, what will happen next? Will we have UKBA squad on our doorstep and what are our rights? Do they have legal right to enter our house? What happpens if we are out, does that mean they have the right to break into ouir home to seek my partner to remove him?
I really appreciate any advice on this matter - I am so stressed out and really scared of what will happen to my partner.
Our solicitors are a bit vague other than saying wait and see what happens .
