In-country switch from Tier 4 visa to Tier 2

Hi All,

Please help. I have a job offer to work as a Quantity Surveyor in Scotland earning 38,000 per year. I am here on a Tier 4 visa, arrived in August 2013, my classes are complete, i have passed the first set of exams. I came with my two children. i would like to switch to a Tier 2 visa. The employer has done the resident labour test. Can I switch in-country? I previously had a work permit in 2004 and worked for a year before moving to Dubai. Does having children in school justify an in-country switch before graduation? The job is NQF level 6.

you haven't provided enough information.

The requirements for in-country switching from T4 to T2G are set out in:

paras 16-18 of the T2 policy guidance:

If you find that you don't meet the requirements you can apply from your home country with a restricted CoS. The fact that your children are at school in the UK has no bearing on your eligibility or otherwise to switch in-country

Thank you for your reply. Looks like i might have to withdraw from my course and go back to my home country. Do you know if this will have a negative impact on my application for a Tier 2 visa application? The fact that I chose to withdraw from my course to pursue a job.

no, it should have no bearing on your T2 visa application
